The essential function of the Notary in a declaration of works is to check that all pertinent permits, licenses, requirements and authorizations are met, just as the other requirements required by Law.
There are two different types of new construction declarations, depending on the changes made to the property:
NEW WORK FINISHED
As its name indicates, this situation occurs when the work is completely finished. To do this, said completion must be reflected in a notarized certificate of works’ completion.
NEW WORK UNDER CONSTRUCTION
The second assumption occurs when a new building or renovation is being carried out on a piece of land, which has not yet been completed.
If it is a builder or promoter, the declaration of new construction is mandatory. If it is an individual who builds on their land for his personal use, he must make the declaration of new construction to contract the supplies and obligatorily if he wants to sell, rent or ask a bank for a mortgage loan.
